3. Payment Terms

  • Portfolio rights to showcase completed work
  • Reusable code components and templates

5. Client Responsibilities

Clients are responsible for:

  • Providing timely feedback and approvals
  • Supplying necessary content and materials
  • Maintaining backups of their data
  • Ensuring they have rights to any content provided
  • Testing and approving deliverables

6. Limitation of Liability

Palmetto Interactive's liability is limited to the amount paid for services. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Issues arising from third-party services or platforms
  • Delays caused by client inaction or external factors

7. Confidentiality

We maintain strict confidentiality regarding client information and project details. We will not disclose confidential information to third parties without written consent, except as required by law.

8. Termination

Either party may terminate services with written notice. Upon termination:

  • Client pays for work completed up to termination date
  • We deliver any completed deliverables
  • Client receives source files for completed work

9. Warranty

We warrant that our services will be performed in a professional manner consistent with industry standards. This warranty is limited to 30 days after project completion.

10. Third-Party Services

We may recommend or integrate third-party services (hosting, analytics, etc.). Clients are responsible for:

  • Complying with third-party terms of service
  • Managing their own accounts and subscriptions
  • Understanding third-party pricing and policies

11. Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including but not limited to natural disasters, government actions, or technical failures.

12. Governing Law

These Terms are governed by the laws of South Carolina, United States. Any disputes will be resolved in the courts of Charleston County, South Carolina.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.
